Terms and conditions of sale

General provisions
  1. By navigating in this area, the user accesses www.solisia.com (hereinafter Solisia), accessible via the url: http://www.solisia.com. Browsing and submitting a purchase order on the site implies acceptance of the conditions and data protection policies adopted by the site indicated therein.

  2. These General Conditions of Sale (hereinafter GCS) to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree No. 206/05 amended by Legislative Decree n.21/14 and Legislative Decree 70/03) by the company Solisia, VAT number 02823400300, with headquarters in Via Pradatti 5, 33050, Terzo d'Aquileia, Udine, Italy.

  3. The user is required, before accessing the products provided by the site, to read these GTC which are generally and unequivocally accepted at the time of purchase.

  4. The user is invited to download and print a copy of the purchase form and these GTC, the terms of which Solisia reserves the right to modify unilaterally and without prior notice.

  5. It is possible to use the site and then access products supplied by the same and purchase these in the following languages, Italian, English, German.

Object
  1. These GCS regulate the offer, forwarding and acceptance of purchase orders for products on www.solisia.com and do not, however, regulate the supply of services or the sale of products by subjects other than the seller that are present on the same site through links, banners or other hypertext links.

  2. Before submitting orders and purchasing products and services from different subjects, we suggest checking their conditions of sale.

Conclusion of the contract
  1. To conclude the purchase contract, it will be necessary to fill in the electronic form and send it following the relative instructions.

  2. It contains the reference to the GCS, the images of each product and the relative price, the means of payment that can be used, the methods of delivery of the products purchased and the relative costs of shipment and delivery, a reference to the conditions for the exercise of the right of withdrawal, methods and times for returning the products purchased.

  3. Before concluding the contract, you will be asked to confirm that you have read the GCS including the information on the right of withdrawal and the processing of personal data.

  4. The contract is concluded when the seller receives the form filled in by the user, subject to the correctness of the data contained therein.

  5. The user will be obliged to pay the price from the moment the online order forwarding procedure is completed. This will be done by clicking on the 'Submit the order' button at the end of the wizard.

  6. Once the contract is concluded, the seller takes charge of the order for its fulfillment.

Registered users
Payment Methods
  1. In completing the registration procedures, the user undertakes to follow the instructions on the site and to provide his/her personal data in a correct and truthful manner.

  2. Once registered, the user will receive a confirmation email in the email provided by him. The confirmation must be communicated within 48 hours at the latest. After this period, in the absence of confirmation, Solisia will be released from any commitment to the user.

  3. The confirmation will in any case exempt Solisia from any responsibility regarding the data provided by the user. The user undertakes to promptly inform Solisia of any change in his/her data at any time communicated.

  4. If the user then communicates inaccurate or incomplete data or even in the event that there is a dispute by the interested parties about the payments made, Solisia will have the right not to activate or suspend the service until remediation of the related deficiencies.

  5. On the occasion of the first request to activate a profile by the user, Solisia will assign to the same username and password. The latter acknowledges that these identifiers constitute the system for validating the user's access to the Services and the only system suitable to identify the user who will be attributed to the acts performed through such access and will have binding effect on him.

  6. The user undertakes to maintain the confidentiality of his access data and to keep them with due care and diligence and not to transfer them even temporarily to third parties.

Availability of products
  1. Product availability refers to actual availability at the time you place your order. This availability must however be considered purely indicative because, due to the simultaneous presence on the site of more 'users, the products could be sold to other customers before confirming the order.

  2. Even after sending the order confirmation email, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically corrected with the elimination of the unavailable product and the user will be immediately informed by e-mail.

  3. If the user requests the cancellation of the order, prior to the successful shipment of the purchased products, Solisia will refund the amount paid within 30 days from the moment Solisia became aware of the buyer's decision to terminate the contract.

Payment methods and prices
  1. The price of the product will be the one indicated from time to time on the website www.solisia.com, unless there is a manifest error

  2. In case of error Solisia will notify the buyer as soon as possible allowing the order confirmation at the right amount or cancellation. In any case, Solisia will not be obliged to supply the goods sold at the lower price incorrectly indicated.

  3. The prices of the site are inclusive of VAT and do not include shipping costs. Prices may change at any time. The changes do not affect orders for which the order confirmation has already been sent.

  4. Once you have selected the desired products, they will be added to the cart. Simply follow the purchase instructions, entering or verifying the required information at each step of the process. Order details may be changed before payment.

  5. Payment can be made through: major credit card circuits.

Delivery
  1. Solisia makes shipments throughout Italy and in all European and non-European countries, with the exception of the following countries (Canada, Australia).

  2. Solisia will only carry out errands by postal shipment to the user's domicile, provided at the time of purchase.

  3. Delivery is made, for the Italian territory, generally within 10 days, and, in any case, within a maximum of thirty days from the date of confirmation.

  4. As for the countries of the European Union the cosegna, only by post, will be made in 30 days and in any case within the maximum term of 60 days.

  5. In the territories outside the EU the delivery will take place in times not estimable, due to shipping times, managed by several national and international companies and the times relative to customs controls.

  6. Solisia is not responsible for delays, omissions, losses of packages sent by the agencies, postal couriers who take charge of the package of the user's order.

  7. If the delivery cannot take place for reasons attributable to us (e.g. failure to ship the package) , after 30 days from the date on which the impossibility of delivery is highlighted, we will assume that you intend to terminate the contract.

  8. As a result of termination, the amounts will be returned, including delivery costs with the exclusion of any additional costs arising from the choice of a delivery method other than the ordinary method offered without undue delay and, in any case, within 14 days from the date of termination of the contract. The transport resulting from the termination of the contract may have additional costs that will be borne by the buyer.

  9. Shipping costs are borne by the buyer and are explicitly highlighted at the time of placing the order.

Passing of risk
  1. The risks related to the products will pass to the buyer from the moment of purchase. Ownership of the products is deemed acquired as soon as the full payment of all amounts due in relation to the same, including shipping costs, or at the time of the purchase if this occurs at a later time.

Warranty and commercial compliance
  1. The seller is responsible for the conformity of the products offered on the site, in accordance with the provisions of Italian law.

  2. In the event of non-compliance, the user who has entered into the contract as a consumer will have the right to obtain the restoration of conformity of the products free of charge, by replacement, or to obtain an appropriate price reduction or termination of the contract with respect to the disputed goods and the consequent refund of the price.

Withdrawal
  1. In accordance with the legal provisions in force, the buyer has the right to withdraw from the purchase without any penalty and without specifying the reason within the period of 14 days pursuant to art. 57 of Legislative Decree 206/2005 from the date of receipt of the products.

  2. In case of multiple purchases made by the buyer with a single order and delivered separately, the term of 14 days begins from the date of receipt of the last product.

  3. The user who intends to exercise the right of withdrawal must notify www.solisia. com by explicit declaration, which can be sent by registered mail with return receipt to the address: Solisia, Via Pradatti 5, 33050 Terzo d'Aquileia, Udine, Italy. The user can also indicate the will to withdraw, indicating the order number and user name by e-mail to the address info@solisia.com.

  4. The purchaser must exercise the right of withdrawal by sending any explicit declaration containing the decision to withdraw from the contract or alternatively send the standard withdrawal form, referred to in Annex I, part B, Legislative Decree 21/2014 not mandatory.

  5. The goods must be returned to: Solisia, Via Pradatti 5, 33050, Terzo d'Aquileia, Udine, Italy. The costs of the return will be borne by the buyer.

  6. The goods must be returned intact, in the original packaging, complete with all its parts and complete with the attached tax documentation. Without prejudice to the right to verify compliance with the above, Solisia will refund the amount of products subject to withdrawal within a maximum period of 14 days, excluding the costs of return by the customer, of whatever nature they are.

  7. The right of withdrawal will not apply if the services and products of Solisia are included in the categories of art. 59 of Legislative Decree 206/2005.

  8. The site will refund using the same means of payment chosen by the buyer at the time of purchase. In the case of payment made by bank transfer, and if the user wishes to exercise his right of withdrawal, he must provide the IBAN, SWIFT and BIC bank details necessary for the refund.

Data Processing
  1. By using the site, the user authorizes the processing of his personal data. This information is also valid for the purposes of article 13 of EU Regulation no. 2016/679, concerning the protection of individuals with regard to the processing of personal data as well as the free movement of such data.

  2. Owner and manager of the treatment is Solisia.

  3. The data is processed exclusively electronically using IT tools and supports designed to ensure the security and confidentiality of the data. The stored information is protected from unauthorized access.

  4. The data provided by users relating to purchase orders, payments (which may contain name, address, contact details), IP address, all other communicated data is processed.

  5. The provision of data and the consent to the processing for the purposes referred to in the contract or the fulfillment of the order and the relative payment is necessary for the conclusion itself as well as for the execution of the contract, therefore the refusal to provide such data or giving consent to the relative processing results in the impossibility for the user to purchase the products and services offered.

  6. The provision of data and consent to processing for commercial communication purposes is optional. However, any refusal to provide such data or to give consent to the relative treatment may result in the impossibility for the user to receive further services.

  7. The user can also revoke the consent to the processing of personal data previously given to Solisia at any time.

  8. All rights established by EU regulation 2016/679 can be exercised by the user by writing to the following email info@solisia.com.

  9. At the first visit the user will be able to choose his own language. To this end, the user authorizes the use of the so-called Cookies identification codes, ie small files sent from his own website server and which can be recorded on the hard disk of the user's computer.

  10. IThe hard disk collects information on the preferences chosen by him on the site and stores the pages visited. Cookies are used to prevent the user from receiving the same information repeatedly and to adapt the content and presentation of the site to the user's browser type.

Applicable law and competent court
  1. These GTC are governed by Italian law and interpreted on the basis of it, without prejudice to any other overriding imperative rule of the country of habitual residence of the purchaser. Consequently, the interpretation, execution and termination of the GTC are subject exclusively to Italian law.

  2. Any disputes relating to and/or resulting from the same must be resolved exclusively by the Italian court. In particular, if the user qualifies as a Consumer, any disputes must be resolved by the court of the place of domicile of the same according to the applicable law.
